بررسی فقهی قانون باروری مصنوعی سال 1382

Abstract:
در قانون اهدا جنین که به منظور باروری زوجین نابارور، مشروعیت باروری منوط به رعایت موازین شرعی شده بدون اینکه آن در قانون معلوم و مشخص شود. با توجه به اینکه بارور کنندگان پزشک می باشند ، لازم است قانونگذار در این قانون تجدید نظر کرده و روشی را انتخاب کند که امکان رعایت ضوابط شرعی باشد و نیز ضوابط شرعی باروی را به طور دقیق مشخص نماید که مهمترین آن، حرمت رحم زوجه دریافت کننده، عده ایام بارداری و حفظ نسب کودک که شکل‌دهنده هویت او است، می باشد.
